Daniele is an intellectual property attorney who specializes in trademarks, copyrights and licensing. In her 12 years of law firm practice, she managed trademark, copyright and domain name portfolios for hundreds of clients ranging in size from individuals to large, multi-national companies. She provides risk analysis based on trademark clearance searches and advises on strategies for trademark prosecution, registration and enforcement. Her practice also includes review of advertisements and marketing materials for proper brand use, potential infringement, FTC compliance, false advertising issues, and consistency across divisions. Daniele served as lead counsel to an energy company through a complete rebranding in the U.S. and more than 45 countries, including selection, clearance and protection of the new name. In addition to counseling clients on trademark matters domestically, Daniele manages foreign counsel to procure, maintain and protect trademark registrations internationally. Additionally, Daniele drafts cease and desist letters, defends trademarks and prosecutes infringements in actions before the Trademark Trial and Appeal Board, and protects and defends domain names in UDRP actions.

Daniele has extensive experience negotiating and drafting licensing and assignment agreements, non-disclosure, confidentiality and non-compete agreements, and settlement and co-existence agreements in disputes regarding trademark, copyright, Internet web site content and domain name infringements. She has also prepared employee intellectual property agreements, consulting agreements and corporate intellectual property policies. In addition, Daniele consults on rights of privacy and rights of publicity issues and drafts photo/media releases. She has drafted rules and related documents for sweepstakes, contests, and promotions. She also conducts intellectual property securities and liens clearance in due diligence for commercial lending and merger transactions.

During her time with Hargray Communications, Daniele worked directly with General Counsel and other executives on corporate and legal matters. She drafted, reviewed and advised on complex transactional documents, including operating agreements, master services agreements, confidentiality and non-disclosure agreements, trademark license agreements, employee benefit agreements, sub-reseller agreements, and easements. She also developed and updated form agreements for use in common transactions.
