FisherBroyles partner, Tiffany N. Comprés, rapidly settles $2 million arbitration case.

(Miami – September 30, 2020)—FisherBroyles, LLP partner, Tiffany N. Comprés, has successfully settled an International Chamber of Commerce (“ICC”) arbitration case worth close to US $2 million, just four months after filing the request for arbitration.

The case involved defects in bagel chips, which led to rejection of the products by a major U.S. retail supermarket chain. The respondents had filed a counterclaim of approximately US $500,000, but ultimately paid the Claimant over US $1 million.

Comprés filed ICC proceedings in April 2020 against the Israeli manufacturer and its U.S. affiliate, alleging that the bagel chips were virtually disintegrated by the time they reached the United States, and further alleging numerous customer complaints.

Comprés worked closely with local Israeli counsel, who immediately filed a pre-judgment writ of attachment against the Israeli manufacturer in aid of the ICC arbitration.

The parties reached a settlement soon after the file was transmitted to the tribunal, and the tribunal rendered an award by consent in September at the parties’ request.
