Partners Booher and Robins publish broad privacy law review article emphasizing new law and COVID measures.

Firm partners, Kimberly Dempsey Booher and Martin Robins have published in the Marquette University Intellectual Property Law Review (Vol. 24) a comprehensive article on American privacy law entitled, “AMERICAN PRIVACY LAW AT THE DAWN OF A NEW DECADE (AND THE CCPA AND COVID-19): OVERVIEW AND PRACTITIONER CRITIQUE”

The article is unique in several respects:

  • Unlike most other law journal articles, it draws heavily upon the authors’ experience in the field as members of the Firm’s Privacy practice group serving clients on a daily basis;
  • It contains an author critique of existing and emerging authority from both a policy and practicality perspective – not merely stating black letter law for daily guidance, but whether it serves any social purpose;
  • It is quite broad in scope, addressing traditional information security obligations as well as emerging issues around permissible use of personal information in marketing and advertising under Federal Trade Commission direction,  California  and other state legislation and related aspects of the European Union’s General Data Protection Regulation, and special obligations around monitoring of internet usage by children; and
  • It contains a detailed discussion of privacy considerations around technological strategies intended to deal with the COVID-19 situation.
