Partner Spotlight – Robert Ellerbrock

How long have you practiced law and what is your practice area?

I have been practicing law for 20 years, focusing throughout on employee benefits and executive compensation issues.

Prior to law school I worked as a consultant in the retirement plan industry. This experience provides me with a unique perspective on issues companies face, allowing me to craft practical solutions to client problems.

Who is your typical client?

My clients range from international publicly traded companies with complex executive compensation and employee benefit programs to small companies with single-person retirement plans and everything in between. I also work closely with colleagues in other practice areas to identify potential I.R.C. 409A issues which are associated with structured deferred payments to employees.

Additionally, I work with companies including start-ups to create equity plans designed to attract and retain talent.

How would you describe the ERISA/Executive Compensation practice area at FisherBroyles?

The practice is exciting and professionally challenging with a collaborative approach to meeting the needs of our clients. We are always willing to provide a sounding board for each other ensuring the highest-quality service for clients.

How is it different from previous law firms you have worked at?

The Firm’s straightforward approach to compensation differs considerably from my prior firms. This transparency creates a collaborative culture which incentivizes synergy rather than competition – a significant difference from most traditional law firms.

The lower overhead costs enabled by the Firm’s distributed model allows me to be more flexible in setting my rates. I can therefore serve my clients in a more cost-efficient manner without many of the administrative burdens required at traditional law firms.

Have you been able to grow/build your personal practice since joining the Firm? If so, how and has the Firm’s model enabled that?

Since joining the Firm in 2020, I have successfully expanded the scope and complexities of my practice. This is in part due to FisherBroyles’ full-service offering, the Firm’s international footprint and collaborative culture.
