    • “LexisNexis® Practical Guidance for Corporate Counsel: Ethics For In-House Counsel”, Author (2012-current)
      • Attorney-Client Privilege: This practice note provides guidance on the attorney-client privilege. It discusses the difference between the attorney-client privilege and the duty of confidentiality; when the client is an entity; the nature, scope, and duration of attorney-client privilege; the reasonable belief test; joint representation; jurisdictional considerations; waivers and exceptions; and the challenges of new technologies, among other topics.
      • Who Is In-House Counsel’s Client?: This practice note provides guidance on the identification of the in-house attorney’s client. It discusses the organization as the client, avoiding conflicts of interest and loss of privilege, Upjohn warnings, and dealings with constituents.
      • In-House Counsel’s Role as Whistleblower: This practice note discusses in-house counsel’s role as whistleblower under the Sarbanes-Oxley Act (SOX), American Bar Association (ABA) Model Rules of Professional Conduct, and state ethics rules.
      • Conflicts of Interest for In-House Counsel: This practice note addresses conflicts of interest that may implicate a lawyer’s duties of loyalty and confidentiality and impair their independent professional judgment. This is emerging as an area of increasing complexity for in-house counsel and legal departments. There is little guidance available in detecting and solving these conflicts as they surface in the public eye in the form of breach of fiduciary duty lawsuits against in-house counsel and their corporate employers and legal malpractice claims, seeking remedies such as civil damages, disqualification, fee forfeiture, and professional discipline.
      • Unauthorized Practice of Law: This practice note on the unauthorized practice of law includes discussion of state regulations, multi-jurisdictional practice, ABA Model Rules on Unauthorized Practice, special registration rules and other options for admission. It also provides guidance on out-of-state in-house counsel working remotely, licensing and attorney-client privilege, and unauthorized practice from the use of non-lawyers.
