Robert Hoskyn is a partner in the Atlanta office of FisherBroyles, LLP where he focuses his practice on complex business litigation.  Mr. Hoskyn has a national practice representing both plaintiffs and defendants in a wide variety of business-related litigation including contractual disputes, complex commercial litigation, breach of fiduciary duty, negligence, fraud, tortious interference, corporate and partnership issues, and other business torts.

Mr. Hoskyn also has considerable experience in large, multi-party civil actions, including multi-district and class action litigation, with an emphasis on products liability and mass/toxic tort defense related to alleged exposure to a variety of chemical products.  As a result of Mr. Hoskyn’s work in this particular area of the law, he was named as a member of a 2013 U.S. News & Best Lawyer First-Tier nationally ranked products liability defense team.

In addition to litigating matters in federal and state courts throughout the country, Mr. Hoskyn has represented clients before the United States International Trade Commission, as well as in general transactional matters, franchisor/franchisee and licensing agreement negotiations, intellectual property disputes and title insurance defense matters.  He has also represented many of his clients in mediation and other forms of alternative dispute resolution.

Recent Representations:

Represented world’s largest home improvement retailer in connection with multidistrict litigation involving alleged claims of pulmonary and neurological injuries following use of a spray grout sealant sold in 1,300 stores nationwide.  This was one of the largest MDL proceedings in the United States consisting of 204 cases pending in 28 federal districts. First five “bellwether” cases were tried to complete defense verdict in April 2010.

Represented world’s largest home improvement retailer in successful defense of multi-state class certification attempt relating to alleged breach of warranty and consumer fraud claims in connection with CCA-treated wood.

Represented a Fortune 100 pharmaceutical company in multidistrict class action litigation related to allegations of personal injury from use of the prescription drug Vioxx.

Successfully defended Fortune 1000 company in multi-party products liability actions in Florida and Mississippi arising from allegations of pulmonary and neurological injuries as a result of exposure to PVC off-gases and exposure to methanol, respectively.

Secured seven-figure summary judgment victory in action to enforce bank’s note and other loan documents and in defending lender liability claims.  This judgment was upheld by the Georgia Court of Appeals in March, 2014.

Prior to joining FisherBroyles, LLP, Mr. Hoskyn practiced for 13 years in the litigation group at Morris, Manning & Martin, LLP.  Mr. Hoskyn resides in Marietta, Georgia with his wife and three children and enjoys tennis and coaching youth sports, including football and wrestling.
